What is a Guaranteed Issue Health Insurance Plan?
A Guaranteed Issue health policy is an insurance plan that legally cannot deny you coverage, regardless of your medical history, age, or gender.
The insurance company is prohibited from asking health questions or looking at your medical records to decide whether to sell you a policy.

When is the Door Actually Open?
Guaranteed Issue doesn't mean you can buy insurance the day you get sick. In order to purchase an HMO plan through the health insurance exchange or medicare, you have to pay attention to specific dates and events.
- Open Enrollment Period (OEP): For most Texans, this happens once a year (usually Nov 1 – Jan 15). During this time, every major medical plan on the exchange is a guaranteed issue plan.
- Special Enrollment Periods (SEP): If you have a qualifying life event, like losing your job, getting married, or moving to a new county, the door swings open for a short window (usually 60 days).
- Medicare Supplement (Medigap) Windows: When you first turn 65 and enroll in Medicare Part B, you have a 6-month guaranteed issue window to buy any Medigap plan without being denied for a pre-existing condition.

The Two Types of Guaranteed Health Plans in Texas
In 2026, you’ll likely encounter two very different versions of this concept:
- Major Medical (ACA Complaint Plans): These are the comprehensive plans that cover everything from hospital stays to prescriptions. They cannot deny you, and they cannot exclude your pre-existing conditions. These plans are either PPO or HMO plans that are available through your employer’s health benefits package or to individuals via the health insurance exchange (marketplace).
- Guaranteed Issue Limited Medical Plans: These are lower-cost plans that protect you in specific situations. They are often disease specific or accident specific plans. They are not designed to provide all of the major medical benefits.
The Price of the Open Door
It’s important to understand the trade-off. Because insurance companies have to take everyone, including those with high medical costs, the premiums for guaranteed issue major medical plans are generally higher than underwritten plans. You are paying for the certainty that your medical history can not be used against you.
